Areas of Practice

Pre-and-Post-Marital Agreements

Without a prenuptial (PreNup) or postnuptial (PostNup) agreement, most couples are unaware they have signed away many of their individual property rights in accordance with the CA Family Code’s community property law system. Issues centered around Money and Communication tend to be among the top reasons for divorce, and one of the many reasons to enter into a PreNup is to foster healthy communication about finances from the onset of marriage.

Divorce, Custody & Support Issues (Child & Spousal)

Divorce and family law issues can be frightening, and often are among the darkest days of people’s lives. Unlike other firms that take advantage of the litigation model to antagonize opposing parties and rake up attorney’s fees, our approach is different. We help you reduce conflict and encourage amicable resolutions to foster a better future for you and your children.

Mediation & Collaborative Practices

Your Room, Not the Courtroom: Remain in control of the divorce process by choosing Mediation over the expensive and slow moving court process. Mediation and Collaborative practices offer a quicker and more comprehensive process helping parties manage potential conflict, build healthy co-parenting relationships, and reduce the stress of court and litigation.

Restraining Orders

In California, a Domestic Violence Restraining Order (DVRO) is first issued on a temporary basis and often liberally granted. We help victims of abuse in requesting restraining orders as well as defend clients where restraining order requests are used to unfairly gain advantage.

Legal Separation

Akin to divorce, a legal separation in California allows a court to order the division of property and assets, child custody, and support; while the parties remain married. There are many reasons why clients may wish to pursue a legal separation in lieu of divorce, and we are here to advise you on your best and most appropriate course of action.

LGBTQ

Akin to family, domestic challenges are diverse and come in all shapes and sizes. While many family law issues are straightforward for the LGBTQ community, others are not. Mindful Legal appreciates the unique challenges in LGTBQ dissolution, domestic partnerships, surrogacy, same-sex adoption, child custody, visitation, prenuptial agreements, and co-habitation agreements.
